Image Usage Rights

All users, regardless of plan type, may use generated images for both personal and commercial purposes. This includes using images in marketing materials, products, websites, social media, and other commercial applications.

• You may use generated images for personal and commercial purposes
• You may use images in products you create and sell, templates, designs, and creative projects
• You may modify and adapt the images
• No attribution required (though appreciated)

Restrictions: While you have broad usage rights, the following restrictions apply:

• You may not show identifiable people in a bad light or in a way that is offensive
• You may not sell unaltered copies of images (e.g., as posters or prints without modification)
• You may not imply endorsement of your product by people or brands on the imagery
• You may not redistribute or sell images on other stock photo or wallpaper platforms
• You may not use images as part of your trademark, design mark, trade name, business name, or service mark without significant modification
• You may not use images that infringe on third-party trademarks, personality rights, or other rights
• You may not use our service to generate illegal, harmful, or inappropriate content

Plan Differences

While all plans allow commercial use, paid plans offer additional benefits:

User Content Responsibility

You are solely responsible for all images, content, and materials you upload to our service. By uploading content, you represent and warrant that:

• You own the rights to the uploaded images or have obtained all necessary permissions, licenses, and consents
• You have the right to use the uploaded images for AI image generation purposes
• The uploaded images do not infringe upon any third-party rights, including copyright, trademark, privacy, or publicity rights
• The uploaded images comply with all applicable laws and regulations
• The uploaded images do not contain prohibited, illegal, or harmful content

You acknowledge that:

• We do not verify, endorse, or assume responsibility for the content you upload
• We are not liable for any copyright infringement, legal issues, or damages arising from your use of uploaded images
• You will indemnify and hold us harmless from any claims, damages, or expenses resulting from your uploaded content
• We reserve the right to remove or refuse to process any uploaded content that violates these terms

If you are unsure whether you have the right to use an image, do not upload it. Using copyrighted images without permission may result in legal consequences for which you are solely responsible.

Service Usage

By using our service, you agree to use it responsibly and in accordance with applicable laws. You may not use our service to generate illegal, harmful, or inappropriate content. See the Acceptable Use Policy below for the full list of prohibited content and conduct.

Acceptable Use Policy / Prohibited Content

To keep our platform safe, lawful, and usable for everyone, the following content and uses are strictly prohibited. You agree not to use our service (including text prompts, image uploads, image generation, video generation, and any other features) to create, upload, generate, request, transmit, store, or distribute any of the following:

• Child sexual abuse material (CSAM) in any form, real or synthetic, is strictly forbidden and will be reported to the appropriate authorities (including, where applicable, the National Center for Missing & Exploited Children) to the extent required or permitted by law.
• Non-consensual intimate imagery, "revenge porn," upskirting, voyeuristic content, or any sexual content depicting real people created or shared without their explicit, verifiable consent.
• Sexual deepfakes or sexualized impersonation of any real person, including public figures and celebrities.
• Graphic violence, gore, torture, self-harm, suicide promotion, or content glorifying or encouraging harm to oneself or others.
• Hate speech, harassment, threats, or content that demeans, dehumanizes, or incites violence or discrimination against individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or other protected characteristics.
• Terrorist, extremist, or violent-organization content, including recruitment, propaganda, or instructions for attacks.
• Content that promotes, facilitates, or provides instructions for illegal activity, including the manufacture or use of weapons (including firearms, explosives, biological, chemical, radiological, or nuclear weapons), illegal drugs, fraud, hacking, or evasion of law enforcement.
• Misleading, deceptive, or fraudulent content, including scams, phishing, fake identification documents, forged signatures, counterfeit currency or goods, or misinformation/disinformation designed to deceive (including fabricated "news," falsified evidence, or election interference).
• Impersonation of real people, brands, or organizations in a manner intended to mislead, defame, or cause harm.
• Content that infringes the intellectual property rights, trademarks, publicity rights, or privacy rights of others.
• Malware, viruses, malicious code, or content intended to damage, disrupt, or gain unauthorized access to any system, network, or data.
• Spam, bulk unsolicited messaging, or automated abuse of the service.
• Any other content that is illegal under applicable law in your jurisdiction or in the jurisdictions in which we operate.

Enforcement. We use a combination of automated safety systems and human review to enforce this policy. We reserve the right, in our sole discretion and without prior notice, to:

• Refuse, block, filter, or remove any prompt, upload, or generated output that violates or appears to violate this policy;
• Suspend or permanently terminate your account and revoke access to the service, with or without refund;
• Withhold, delete, or quarantine generated content and uploaded files;
• Cooperate with law enforcement and report violations to appropriate authorities, including reporting CSAM and other illegal content as required by law;
• Preserve and disclose account information and content as necessary to comply with legal obligations or to protect the rights, safety, or property of users, third parties, or ourselves.

You are solely responsible for your use of the service and for any content you submit or generate. Violation of this Acceptable Use Policy is a material breach of these Terms of Service.

Content Rights

You have the right to use, modify, distribute, and commercially exploit the images you generate through our service. We do not claim any rights to your generated content beyond what is necessary to provide our service.

Important: As noted in the Image Usage Rights section, copyright protection for AI-generated images varies by jurisdiction. In many countries (including the U.S. and EU), images created solely through prompt engineering are generally not eligible for copyright protection, even if you create your own prompt. However, laws differ—some jurisdictions (like the UK) may grant copyright protection under certain circumstances. This applies equally to free and paid plan users.

If you make substantial creative contributions beyond prompting (such as editing, combining, or arranging images), those human-authored elements may qualify for copyright protection in many jurisdictions, but the underlying AI-generated images themselves may remain uncopyrightable depending on your jurisdiction. We recommend consulting local copyright laws for specific guidance.

Community Shared Images

When you share images publicly in our community gallery, whether you are on a free or paid plan, you grant a permissive license allowing others to download and use them for both personal and commercial purposes. This policy applies equally to all users regardless of plan type and reflects the current legal understanding that AI-generated images without significant human authorship are not eligible for copyright protection under U.S. law.

• Downloaded shared images may be used for personal and commercial purposes by anyone
• This applies to images shared by both free and paid plan users
• Attribution to the original creator is appreciated but not required
• Users may modify, distribute, and use shared images in their projects
• Users may not claim exclusive ownership or copyright over downloaded shared images
• Users are responsible for ensuring their use does not infringe on third-party trademarks or rights

If you do not want your images to be downloadable or used by others, do not mark them as public when sharing. By sharing publicly, you acknowledge that others may freely use your shared images, regardless of whether you are on a free or paid plan.

Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access. We reserve the right to modify or discontinue the service with reasonable notice.

Limitation of Liability

Our service is provided "as is" without warranties. We are not liable for any damages arising from the use of our service or generated content.

Changes to Terms

We may update these terms from time to time. Continued use of our service after changes constitutes acceptance of the new terms.
